Au Pair? Take Care!

So you're planning to hire an au pair through a foreign agency to watch your children in exchange for room and board for six months to a year. What are your insurance considerations?
Workers' compensation. Under Connecticut Workers' Compensation Law, the arrangement with this individual requires workers' compensation coverage if employed more than 26 hours per week, despite the absence of monetary remuneration. An "employee" means any person who has entered into or works under any contract of service or apprenticeship with an employer. A standard workers' compensation policy will provide the necessary coverage.
Automobile. Medical payments and uninsured/underinsured motorists benefits would be available if the au pair were injured while occupying the family's auto under a personal auto policy.
Reparations benefits would provide broader protection to include injuries while occupying a borrowed or rented auto operated by an insured family member.
The au pair also would be insured for liability while operating the family's auto with permission.
Homeowners policy. The au pair's personal property is covered by the homeowners policy only when it is located on premises occupied by the insured. The au pair is not insured for liability coverage afforded by the homeowners policy.
